(TheLibertyRevolution.com)- Senator Mike Lee (R-UT) and Congressman Chris Smith (R-NJ) are calling on the Justice Department and the FBI to investigate whether a DC abortion clinic violated the law after five near-term fetuses were discovered in a box containing over 100 pulverized first-trimester fetuses.
Pro-life advocates from the Progressive Anti-Abortion Uprising recently recovered the box containing fetal parts that were being sent from the Washington Surgi-Clinic to Curtis Bay Medical Waste Facility for disposal. The activists routinely recover such remains to give the fetuses a proper funeral, but this particular box contained the remains of five third-trimester fetuses.
The Republican lawmakers want the DOJ to investigate whether the deaths of these five near-term fetuses violated the law banning partial-birth abortions.
The Partial-Birth Abortion Ban Act of 2003 bans abortions where the physician “deliberately or intentionally vaginally delivers a living, unborn child’s body” for the purpose of performing an abortion, usually by puncturing the back of the child’s skull and removing the brain.
In their letter, the lawmakers cite a photograph of one of the five fetuses, a girl, whom a neonatologist, Dr. Kendra Kolb, estimated to be between 28-30 weeks gestational age. The photo shows evidence of “deep lacerations to the posterior neck” which correlates to the method used in partial-birth abortions.
The nation’s capital does not have laws restricting abortion at any point during pregnancy, meaning, in Washington DC it is legal to abort a child at any time through the nine months of pregnancy.
The DC Metropolitan Police Department had already concluded the five late-term fetuses were legally aborted. However, in their letter, Senator Lee and Congressman Smith question the MPD’s official statement, noting that the department couldn’t know since no autopsies were performed to determine an official cause of death.
In addition to requesting an investigation, the lawmakers also request that the bodies of the five fetuses be preserved “as evidence for future investigations.”
Earlier in the week, Republican lawmakers also called on both DC Mayor Muriel Bowser and the DOJ to investigate the five late-term abortions, asking that autopsies be conducted on all five and the bodies preserved as evidence.
